Abstract

This writing is in the framework of normative legal studies, by examining licensing issues and the environmental impact of oil palm plantations in Merangin Regency, the root of the problem lies in the function of local governments in oil palm licensing, because the government here is primus inter pares (not the owner or ruler of the state). and the people), as a civil servant, who has the task of leading the community in carrying out social and state life, in this case in the context of oil palm plantations. Normatively, there are efforts to regulate or rearrange licensing laws in the regions at this time in the context of implementing decentralized, democratic local government, as well as the integration of the interests of the preservation of environmental functions into it, which is quite an urgent need. In Merangin itself, oil palm plantations reach 57,258 hectares, but in this case there are many licensing problems, most of the problems occur when the plantation is started, burning land without coordination will create environmental problems, and other problems that often arise in Merangin are opening plantations. first then take care of the permissions, this is clearly a faulty system. Companies or individuals in land clearing must pay attention to the environmental impacts that can be caused.
